Legislation would revamp federal contracting policy impacting small design and construction firms

Legislation was introduced in the U.S. House of Representative this month to ban reverse auctions when an agency determines small businesses are qualified to bid on the solicitation.

Legislation was introduced in the U.S. House of Representative this month to ban reverse auctions when an agency determines small businesses are qualified to bid on the solicitation. In addition, a bill to mandate the use of a two-step process to evaluate design and build procurements is up for debate. Construction, and architecture and engineering services accounted for about 8%, or $41.6 billion, of all federal procurement in 2012. Instead of reverse auctions, agencies would be required to use another contracting process, such as sealed bid or a negotiated procurement.
